Will I pay or receive spousal support in New York?

There is no formula like child support for the payment of spousal support after a case has been resolved *.

The payment or receipt of spousal support depends upon many factors, such as the parties’ current income, their potential earning capacity, tax impact, assets available to the parties, the length of the marriage, whether or not one party gave up his or her “career” to be a “homemaker”, and many other relevant factors. Your mediator will need to work with you and your spouse in order to determine whether maintenance is appropriate and/or necessary.

Our mediators will be happy to help you determine the best option for your family during this difficult time. Contact us now at (631) 419-6111 or contact us online for a Free Consultation.

*There is a statutory formula for calculating spousal support that the Court must apply while your case is pending in Court, this is called pendente lite support. This formula is not required to be applied once your matter is resolved via settlement or Court order.
